The "N" Word


Benny Pina was another Phoenix Police dic that worked on the Baseline task force. Another reminder from someone who “was part of PLEA” (Phoenix Law Enforcement Association) reminds us again of Lt Pina and Sgt Mike Polombo calling my husband the “n” word.

"I was part of PLEA years ago when specific allegations were made against Pina and Polombo using the "n" word in a derogatory way toward K. Robinson and Mark Goudeau, along with using derogatory terms about Klima and his religion. Both denied the allegations and the case was closed. Seems Pina has not changed one bit. Lets hope he finally gets held accountable this time. Everyone knows Pina is a piece of shit since he became a LT and CMDR. He was actually decent when he was a Sgt. Polombo is just a bottom feeder and we all will be there karma catches up with him one day. BPC, I know of at least one actual photo of his whore wife Heather giving a BJ to an officer in uniform and it is rumored there is about 3 others. What a prize it would be to get your hands on one of those photos!"

DNA - Dry to Wet | The Switch

Department of Public Safety DNA Analyst, Lorraine Heath, claims her strongest DNA partial profile was from a woman’s breast, who was face down, submerged in a tub filled with water. (Sorry to be so graphic but the details are important.) Although two witnesses testified they dried those swabs, Heath claims the swabs she had were wet and stored differently than all the other swabs in this case, and all the other Baseline cases. These two DNA swabs were not tested until 5 months later. The issues? If these swabs really were stored wet for 5 months before testing, then degradation is a probability making for unreliable to no results given that mold would have developed, and not to mention DNA dissolves in water. It would be nearly impossible for there to be any DNA considering the state the body was found (wet) much less with the issues of it being stored wet.  

Secondly, if two professional already testified, a doctor and detective, that they dried and then stored the swabs in a way to keep them dry, how is it that two swabs are wet once Heath becomes involved? These being only swabs she is able to get any results?

Inanimate things just don't morph into something different! It would be the same as if the State had put a pistol into evidence, but by the time the ballistics expert gets it, it changed to a rifle.

Every single swab and even useless extracts in this case were consumed/destroyed by the State. Not a single fiber that the defense could use for re-testing. Nothing.

Then there is the case of the woman who is murdered at a car wash with the surveillance video of the attacker pushing her into the back seat of her own car, and him getting into the driver’s seat and driving away. Yet the DNA in the “driving area” EXCLUDES Mark. The DNA is that of an “unknown male” better known as the real attacker. 

So how is it Heath is able to get a partial profile in a nearly impossible scenario of degradation from water and the mysterious switching of swabs, yet in a perfect scenario of the attacker’s DNA in the dry driving area – ignition, steering wheel, etc. – Mark is excluded? 

Not only does the DNA in this entire investigation make absolutely no sense and defies science, but every shred of DNA evidence has been entirely consumed/destroyed by the State/Lorraine Heath.

What was not presented at trial


  •  The extensive cover up of Baseline suspect Terry Wayne Smith. Officer Rusty Stuart compiled a nearly 200 page report on TWS that was presented to the Baseline task team numerous times and was constantly told to just go away. This report was also kept secret by the State prosecutors and County Attorney, Andrew Thomas. (Officer Stuart, under protection of an attorney, wrote an extensive letter to the County Attorney due to the retaliation he suffered as a result. )
  • The memo published on the Phoenix Law Enforcement Association’s website,to Sheriff Joe Arpaio that talks specifically about Mark being called a NIGGER by members of the Baseline task team.
  •  One example of the DNA findings involves a woman who was shot and placed face down in a tub of water for hours before discovered.  The State claims they were able to obtain DNA from saliva from her breasts, yet DNA is water soluable.  In other words, DNA dissolves in water. DNA industry literature does not support that DNA can be obtained in these conditions.
  • ·That every single piece of DNA evidence that is tested by Phoenix Police crime lab EXCLUDES Mark. It’s not until dirty dics Alex Femenia and Mike Mieshlish enlist henchwoman DPS DNA analyst Lorraine Heath, after Mark’s arrest, that they get any results where Mark cannot be excluded. The above is one of the examples of Heath’s incredulous DNA findings.
  • By the polce and forensic lab’s own reports, it can be proved that DNA evidence was planted. This should have been addressed by Mark’s attorneys immediately upon discovering this, yet they did nothing.

Mark's Recorded Phone and Jail Conversations - Over 1800!

Five years of recorded daily phone calls and recorded jail visit conversations that occurred 3 times a week, all recorded.  Five years worth of recorded conversations.  That would be over 1800 recorded conversations! If Mark were guilty of any of the Baseline crimes, surely he would have said something, sometime incriminating if he had any involvement.  Humans can’t help but talk. It’s how we’re wired.  But Mark, since he did not commit any of these crimes; therefore no knowledge of these crimes, what incriminating thing could he say?  The answer, of course, is nothing!  Which is why not a single conversation was used by the State at trial.  Not one.

Trial Update 9.9.11

The trial update is there really is no update.  Court was held Wed and 1/2 day Thursday.   Victims and witnesses who can’t ID their attacker. A slew of State DNA  analyst who had excluded Mark’s DNA. 
Yoshi double homicide, the previous week, was done in two days.  Two days! Things move quickly when there isn't a single piece of evidence.
It's as if the State thinks the absence of evidence, is evidence. We’re still wondering how this has come this far.

Officer Rusty Stuart Writes About Terry Wayne Smith Cover Up by Basline Taskforce

Letter from Ofc Rusty Stuart where he writes of his repeated efforts to have Terry Wayne Smith investigated further by the Baseline task force - Alex Femenia, Mike Polombo, Mike Mieslish.  Ofc Stuart also took his nearly 200-page TWS report to the county attorney's office, where it was also swept under the rug. Let's not forget Andrew Thomas is in the process of being disbarred due to abuse of power and corruption while holding that office.   Not to mention Chief Jack Harris forced to turn in his resignation also for abuse of power, corruption and fraud.  Unfortunately these investigations didn't involve the corruption directly related to the Baseline case. 

Task team case manager, Alex Femenia, wouldn't even look at Smith for fear it would give Mark, or as Alex allegedly calls him, "this nigger" an alibi. (The nigger remarks was in a memo to Arpaio that the Phoenx Law Enforcement Association posted on their site.)
