Love how the regime that the Baseline investigation operated under has disintegrated as a result of it's on unlawfulness. This regime of County Attorney Andrew Thomas and Chief of Police Jack Harris have left office in the disgrace of corruption, abuse of power, and fraud.

One day the fact that Harris had his goons burglarize my home in a desperate attempt to gather information, will come to light.

One day Thomas will actually be held accountable for hiding the extensive police investigative report of violent and deviant viable Baseline suspect, Terry Wayne Smith.

The 2007 trial of which Mark was convicted of rapingAlejandra and Lorena Lara, was presided over by Judge Andrew G. Klein.

Judge Klein recused himself from presiding over any other ofMark’s upcoming trials because Klein felt he could not do so impartially orwithout prejudice. Klein also made awful remarks about Mark off the record, Iam told. Clearly this man needed to recuse himself, and thankfully he had theintelligence to do so.

However, the appeal for the 2007 conviction recently wentright in front of this very same man, judge Klein. The same man who recusedhimself because he could not make decisions in any further proceedings in Mark’scase without bias and his own personal feelings.

So it was no surprise that Mark’s appeal, whom Klein alreadyadmitted he could not deal fairly with, was denied. An appeal that introduced new evidence – the cover up of the extensive investigation of Terry Wayne Smith by Officer Rusty Stuart. Regardless that the prosecutors SusanneCohen, William Clayton, Patty Stevens, and task team dics Alex Femenia, MikePolombo, Mike Mieslish and others hid this report isn’t relevant for purposesof the appeal. New evidence is newevidence, regardless of how it was found and cases are overthrown and new trialsare ordered when there is new evidence this substantial.

But like a dog returning to its vomit, Mark’s appeal wentright back to the very judge who already admitted that his own personalfeelings prevented him from being fair in regards to Mark.

Legal Separation

For the record, Mark and I agreed to a legal separation in an attempt to protect myself financially. I, along with Mark, am being sued by 3 families of victims. The legal separation in no way diminishes my support for Mark, an innocent man framed by Phoenix police who were under enormous pressure to make an arrest. I will remain a constant in Mark’s life as I have the last 5 years. Nothing changes. These are the families who are suing:

Alvin Hogue who’s wife was one of the two women murdered in their lunch truck on lower Buckeye. Facts: Interviews with construction workers said the two women were known to sell drugs out of the lunch wagon. Hogue also confided in his friend that his wife was selling drugs out of the lunch truck. Murdered over drugs? Also, a close friend of Hogue’s went to police telling them she thinks Hogue is responsible for his wife’s death and that he’s prone to violent fits of jealously and rage. (In fact, in one of his rages Hogue badly hurt one of his children, dislocating his son’s shoulder.) Hogue also told her he didn’t believe Mark was the Baseline Killer. So why is he suing?

Kristin Gibbons, a prostitute who was murdered shortly after being beat up by two Mexican men. Prosecutors lied to the grand jury and said it was two Black men, since Mark is Black. Police reports show that interviews with her mother and a close friend who owned a taco shop that Kristin called “headquarters” also said it was Mexicans who had beat her up. Did these two Mexican men murder Gibbons? Living such a dangerous lifestyle, who knows who murdered this poor woman.

Sophia Nunez’s family. After Mark’s arrest, the Nunez family hired Pete, a psychic to find out who her real killer was as the Nunez family was not convinced it was Mark. Pete recorded the meeting with photographs, and it was clear in the pictures Sophia’s mom was very unhappy about the psychic meeting. When Pete revealed the name of Sophia’s real killer, her sisters’ suspicions proved true – it was a friend of the family. Also according to police reports, Sophia had also confided to a neighbor/friend that she was being stocked by an “unknown male.” Not Mark.

Shortly after telling her neighbor this, Sophia was murdered. I’d want to also mention that Sophia’s abuse boyfriend and father of her children, Gilbert Martinez, was the first suspect that the family talked with about police. Sophia had split with Gilbert for the final time, after years of abuse, and the family felt he could not deal with it. Gilbert failed a lie detector test. Gilbert should thank his lucky stars that late in the game police turned their focus to Mark, otherwise it would have been Gilbert charged and convicted of her murder.

Police Reports and Trial Testimony Prove DNA was Planted!

All the DNA in this investigation is Y DNA. (This is with exception to the Lara 2007 sexual assault trial, but that was a match of 3 out of 13 genetic markers; too low to even make an arrest.) Y DNA can only identify male family lineages, as testified to at trial. Also, as testified at trial, unrelated males share identical Y DNA profile (matches). So Y DNA cannot and does not point to a single person; therefore an arrest cannot be made.

The only case in this investigation that had the individual, discriminating STR DNA was in the Sophie Nunez homicide. Lorraine Heath, DPS DNA technician, testified that the partial STR DNA profile swabbed from Nunez’s breast was consistent to 9 of Mark’s genetic markers.

Here’s where it gets interesting. Two State witnesses testified at trial that ALL swabs in the Nunez case were placed in a drying room, and then dry paper packaged, including the 2 breast swabs. Police reports also state these same facts.

Yet, when Heath took the stand, she testified that the 2 breast swabs were wet and sealed in a baggie in a glass tube. And these are the swabs that have the partial STR profile that match Mark at 9 loci (genetic markers).

I’ll now ask the obvious: How did these 2 swabs which were entered into evidence dry, change to wet? Packaged completely differently?

Whoever switched these swabs knew nothing about the DNA drying process, but did know that Nunez was submerged in a tub of water, so they planted wet swabs.

Tampered, switched, changed, whatever you want to call it, it is yet another indicative statement how this investigation in its entirety was done – with collusion and intimidation and corruption and racism.

So the message from the jury is . . .

It’s ok for police to search your small house repeatedly until they “find” something. If the police are that incompetent, why stop after the last search? Why not keep coming back? Seriously, if they missed “evidence” the first 3 times, if they’re that bad why not keep coming back for more searches? It’s because they completed their mission by planting the jewelry - the copy of the Walmart ring, void of any DNA – neither Mark’s nor the victim’s. How could Mark’s DNA be there if he never even touched it? As well as the victim. How could her DNA be on a ring that was merely reproduced, never touching her fingers?

It’s ok for DNA evidence to change from dry to wet after it’s been dried and dry packaged in a paper envelope and entered into evidence as such – as testified to by both the autopsy doctor and the case manager. But when DPS DNA tech, Lorrain Heath gets it, it’s wet, in a baggie and glass tube. The only swabs in this case (Nunez) that a partial DNA profile is found. In other words, it’s ok for the State to switch and plant evidence.

It’s ok when the suspect is videotaped by surveillance cameras assaulting a victim, getting in and driving her car away, yet the DNA on the ignition switch and steering wheel and the rest of the driving area EXCLUDES Mark. The jury chose to ignore this exonerating evidence.

It's ok that lead dic Alex Femenia and his crew called Mark the Baseline Killer before any so-called DNA evidence, or evidence of any kind. That it's ok to target innocent people and then serve them on a silver platter.

Although the jury may not have had the entire picture since Mark’s attorneys didn’t present a defense case –, they made the conscious decisions to ignore straightforward testimony of police misconduct and planting of evidence, and targeting Mark before any shred of so-called evidence.

DNA -Wet vs Dry and the Mysterious Switch

Department of Public Safety DNA Analyst, Lorraine Heath, claims her strongest DNA partial profile was from a woman’s breast, who was face down, submerged in a tub filled with water. (Sorry to be so graphic but the details are important.) Although two witnesses testified they dried those swabs, Heath claims the swabs she had were wet and stored differently than all the other swabs in this case, and all the other Baseline cases. These two DNA swabs were not tested until 5 months later. The issues? If these swabs really were stored wet for 5 months before testing, then degradation is a probability making for unreliable to no results given that mold would have developed, and not to mention DNA dissolves in water. It would be nearly impossible for there to be any DNA considering the state the body was found (wet) much less with the issues of it being stored wet.

Secondly, if two people already testified, a doctor and detective, that they dried and stored the swabs in a way to keep them dry, how is it that it changes into two wet swabs once Heath becomes involved? And these two are the only swabs that she is able to get any results on in this case?

Every singal swab and even extracts in this case were consumed/destroyed by the State. Not a single fiber that the defense could use for re-testing. Nothing.

Then there is the case of the woman who is murdered at a carwash with the surveillance video of the attacker pushing her into the back seat of her own car, and him getting into the driver’s seat and driving away. Yet the DNA in the “driving area” EXCLUDES Mark. It is of an “unknown male” better known as the real attacker.

So how is it Heath is able to get a partial profile in a nearly impossible scenario of degradation from water and the mysterious switching of swabs, yet in a perfect scenario of the attacker’s DNA in the dry driving area – ignition, steering wheel, etc. – Mark is excluded?

The DNA in this entire investigation, which makes absolutely no sense, is as attorney Randy Craig describes it – “cooked up!”

The jury is still out.

State's Closing

As expected the majority of the State’s closing arguments were hyped with crime scene photos of victims to stir emotions and prejudice the jury. What actual “facts” Patty Stevens tried to use were fabricated, along with only halves of testimony to hide the actual facts which exonerate Mark. As Channel 15 reported, her closing was finger pointing and name calling. Hype, no real or true facts.

Pete Ochoa
Steven’s played a video clip of witness Pete Ochoa. Ochoa is the man who lied on the stand in drama queen fashion saying that he will never forget the face of the attacker, saying it was Mark. Steven’s didn’t play, of course, the entire video clip of Ochoa’s testimony where he admitted lying on the stand since he really never saw the face of the attacker. Ochoa told not one but two police officers that the attacker had the hood of his jacket covering his head and not only could he not see his face; he couldn’t even tell the police what race the suspect was.

Any witness other witness or victim who lied on the stand were effectively impeached by Mark's attorneys.

Surveillance with white van while / crimes stopped
Stevens argued that the crimes stopped after Mark saw a white van parked in front of our house and realized he was under surveillance. The truth: Not a single office who participated in the surveillance testified that they used a white van, nor parked in front of our house. In fact, the lead surveillance officer testified that the last thing they want to do is let a suspect know they’re under surveillance so they would never be as obvious as Stevens stated. Moreover, he testified he was in a flatbed truck parked down the street and that the surveillance was called off after a few days due to “no suspicious activity.”

As for the crime’s stopping, that statement is just absurd. As if the police are going to call ongoing Baseline crimes after Mark’s arrest, Baseline crimes. The media, at least most of the reporters such as Michael Keifer of the Arizona Republic, only write what the police tell them. So even if the MO is the same as the Baseline crimes, police aren’t going to say that, nor will the media. Further, there is no way every single crime committed in the Valley since Mark’s arrest over the past 5+ years could be compared to the so-called Baseline crimes. With a backlog of cases in the 1000s Phoenix just does not have the resources to do comparisons of every single crime. As Judge Granville stated, making the statement that the crimes stopped “is a bridge too far.”

The conversation that never happened
Stevens also said in closing that Mark and I had a phone conversation about him knowing he was under surveillance. Five years of daily recorded conversations, 5 years of regular jail visit recorded conversation, nearly 2000 in all, the State did not produce a single recording, not one. The prosecution never produced a recording of that conversation. Because it never happened. Just more noise from a hissing gas bag.

There are myriads of issues with the State’s so-called DNA evidence. Here are some of those issues as previously blogged:

But changes once in the hands of Heath. Not only is there the obvious swicheroo going on here, there is also the issue of mold developing and DNA degrading on wet swabs stored for 5 months in that condition.
In 2007 there were 300 in the database, with the Goudeau Y as the only one. Now 2 more UNRELATED males in the 1,200 Y-DNA database whose DNA are IDENTICAL to Mark’s paternal Y-DNA. Can you imagine how many more identical Y-DNA profiles there will be as this database grows? If there are now 3 UNRELATED males with IDENTICAL Y-DNA profiles, how many more in say 1 million?
DNA is water soluble which means it will dissolve or wash away in water. Only Lorrain Heath said she obtained Y-DNA results from a victim who was found face down in a bathtub full of water where she had been for hours. Heath would have a better chance of getting hit by lightening in her lab than she would getting any DNA results in this situation.
That every single raw DNA sample swab was destroyed/consumed by Lorrain Heath leaving absolutely nothing for Mark’s lab to test.
That once Alex Femania and Lorrain Heath found out Chromosomal Labs would do testing on Mark’s case for FREE, Heath destroyed every other remaining swabs, even those they already had results, needed no further testing. Even DNA extracts were destroyed.
The only DNA expert at the so-called Baseline task team meetings with Alex Femenia was none other than Lorrain Heath. No other DNA experts were allowed although there were many, many other DNA analysts involved in the research and testing.
And finally, Heath leaves the country shortly after Mark’s arrest.

It's Hard to Plant a Gun

It was easy for Alex Femenia to obtain crack and plant it, and it was just as easy to obtain a copy of a ring and plant that. (Remember the ring that is completely void of any DNA.) Not so easy to do with a gun given ballistics, although not a perfect science. State’s ballistics expert admitted on the stand that ballistics testing, without the actual gun that was used to fire the bullets, would be inconclusive. But planting a gun was too risky since the chances of the ballistics even being remotely related was too remote. Even dumb ass Alex Femenia knew that.

Mark's Recorded Phone and Jail Conversations - Over 1800!

Five years of recorded daily phone calls and recorded jail visit conversations that occurred 3 times a week, all recorded. Five years worth of recorded conversations. That would be over 1800 recorded conversations! If Mark were guilty of any of the Baseline crimes, surely he would have said something, sometime incriminating if he had any involvement. Humans can’t help but talk. It’s how we’re wired. But Mark, since he did not commit any of these crimes; therefore no knowledge of these crimes, what incriminating thing could he say? The answer, of course, is nothing! Which is why not a single conversation was used by the State at trial. Not one.

Two Unrelated Males who’s DNA is IDENTICAL to Mark’s

The Y DNA is the paternal family DNA that is passed on from male to male on the father’s side and is identical to each male.

The State’s so-called DNA “expert”, Lorrain Heath, testified that the Y DNA found at some crime scene evidence is the Goudeau Y DNA. She combined her calculations of the Y with the more discriminating STR DNA to come up with the hyped, inflated, fantastical likelihood ration you’ve seen in the media, giving the general public the illusion that the DNA was entirely unique and that no one else in the world could share the same genetic markers. She said she got a hit on Mark’s Y DNA in the very small Y DNA database in 2006.

Well, now that the Y DNA database, over the years, has increased in size as other men’s Y DNA is added, there are now TWO MORE Y DNA profiles in this database that are IDENTICAL TO THE GOUDEAUS. And these two identical Y profiles are of UNRELATED MALES OF DIFFERENT RACES - one Black, the other White. Although Heath didn't want to, she was forced to admit on the stand that there are currently two known unrelated males with the same Y DNA as Mark, snapping at Mark's attorney Rod Carter saying "I already told you that when we talked."

There are currently 1,200 Y DNA profiles in this database and as it continues to increase there will likely be more IDENTICAL UNRELATED Y DNA profiles in this database. Can you imagine how many other unrelated males that share the same Y that will never even be in the database?

The more we learn about the DNA in this case, the more we see what crap it is. Did I mention that shortly after Lorrain Heath contacted PPD with misinformation on the DNA resulting in Mark’s arrest, that she left the country?

Shape Shifter

Shape shifting is a change in the physical form or shape of a human or animal. Certain Native American cultures have a similar legendary belief called Skin Walkers. That a human can change to animals and back again to human, or sometimes humans changes to other humans.

Maybe this is what dics Alex Femenia, Mike Meislish and Mike Polombo think of Mark. That he is a shape shifter. How else can it be explained that not a single witness has ID’d Mark; that Mark is excluded from most all of the DNA evidence; that he is excluded from every single finger print that has been lifted from the crime scenes?

Perhaps while Mark was lockedup at the 4th Avenue jail, he morphed himself into a bird and flew home to place a ring in his shoe. How else can you explain the ring was missed by police on the 1st search warrant with the directive to search and seize all men’s shoes, only to be found 3 searches later?

Now it makes sense! Mark transformed himself into different beings so that someone else’s DNA and fingerprints could be left at the crime scenes; the reason that nearly every single witness describes the attacker as someone much younger, shorter and thinner than Mark.

Or is the better explanation that this really is nothing less than police and prosecutorial misconduct and a complete disregard for the truth?

Lunch Wagon Homicide and Red Truck

Prosecutors Cohen and Stevens argued that a red pickup was seen near the lunch wagon the day of the homicides. PPD went to great pains to retain tire marks so the tire treads could be tracked back to the killer. Of course, that never happened. This testimony went on for a bit - I’ll spare you the useless details.

The double homicides were committed February 20, 2006, early in the day. Never mind the description of the truck seen is that of a newer, bigger model, than what Mark owned, that it was also seen later in the day - waaaaaay after the two bodies were discovered, not prior to the murders. If it’s not already bad enough, what’s really interesting here, and I’m using the word “interesting” loosely, is that, yes indeed, Mark did own a small red pickup, unlike the one described by a passerby. But Mark did not own the truck at the time of the murders. It was nearly a month after the homicides that Mark purchased a truck.

So was Mark driving the truck he didn’t own or have access to at the time of this crime??? I know that’s a crazy thing to ask, but how ridiculous and insane is it for prosecutors Cohen and Stevens to completely ignore the fact that Mark didn’t even own a red truck at that time? A simple title check is all it took. Not only can the state not prove that Mark owned a truck, Mark’s attorney’s proved he did not! It was not a hard thing to do.

Let me say it again. Prosecutors spent good time at trial going over tire mark forensics and testimony that a red truck was seen at the scene knowing full well that Mark did not own a truck at the time.

I seriously think Cohen and Stevens are mentally insane. How else can this illogic be explained?? Scary, unstable people whose perception is based on what they think they can just utter in court despite complete lack of evidence, reality, and actual facts. These are dangerous people who will say and do anything to try to secure a conviction, regardless of how wrong and contrary the evidence.

Defense Rests

It was a stunning development when Mark’s attorney rested last Thursday. They will not be putting on a defense. Because not only did the State not prove its case, but their experts and witnesses only helped Mark’s defense team bring the holes, corruption, and inconsistencies to light. Witnesses were impeached and experts, at least those with integrity, made admissions that showed the flaws in everything from the DNA to the ballistics. When a prosecution is built on nothing but lies and fabrications, it’s impossible to fill the holes.

Time and time again the defense was asked “When is the State going to show something.” They never did, so the defense rested.

EXONERATING DNA

Yes, it’s true. DNA evidence that exonerates Mark has been presented at trial – by the State no less. They just choose to ignore it.

One of the “Baseline” homicides, June 30, 2006, was a poor woman murdered at night while she was vacuuming her car at a carwash not far from our home. The surveillance video shows a man approach and assault her. He then throws her into her own car’s backseat. He gets into the driver seat and drives away with her in the back.

The operative word here is VIDEO. The entire awful episode described above was recorded. The man got into her car, started it up, put it into drive, and drove away.

The State’s DNA witness testified that all DNA in the driving area –steering wheel, ignition, door panel, etc. - of the car EXCLUDES MARK! The DNA from the driving area is from an UNKNOWN MALE. NOT MARK!!!

How is it that Mark stands charged with any of these crimes if he is completely EXCLUDED? Furthermore, any DNA that the States claims they have as evidence are all PARTIAL PROFILES - NEVER a match to Mark. Not to mention, there are many, many pieces of other DNA evidence of which Mark is EXCLUDED.

Every single bit of DNA evidence that the State claines Mark cannot be excluded has been destroyed, or as the State calls it consumed, for testing. Not a single piece of raw DNA evidence for Mark to have analyzed by an independent lab in his defense.

The so-called Baseline crimes investigation is a tangled, bungled mess that will never be solved due to the State’s complete incompetence and far reaching corruption.

Pings

When your cell phone is turned on and as you move about the city, your cell phone “pings” on the nearest tower. This GPS information is recorded and saved by cell phone carriers for a period of time and will release this information to law enforcement when subpoenaed. Cell phone location records are obtained immediately by law enforcement so that they can place suspects at crime scenes. It’s basic cop 101.

At will, Baseline detectives Alex Femenia, Mike Meislish, Mike Polombo and others wrote up subpoenas for dozens of people during this investigation. Other suspects, people who talked with Mark on their cell phones, absolutely everybody and anybody they could think of . . . . Except for Mark.

Well you have to ask, why would they not have Mark’s cell tower pings? The very thing that could place him at the crime scenes? They said they tried, but couldn’t get them. Yeah, right. These dics, who would get cell tower ping records at will, are relying on the general public to be gullible.

Here’s the truth: Somehow, some way, maybe through PPDs good ‘ole buddy networking system or their own forensic software, I can assure you they did in fact acquire Mark’s cell tower pings. They had them and discovered that Mark’s pings did not resonate at a single crime scene. So the records were disposed of, and Femenia and the likes lie and say “we couldn’t get them.” These goons are comfortable hiding exonerating evidence. Look how many years they covered up the Ofc Rusty Stuart’s Terry Wayne Smith investigative report.

Mark was put under surveillance July 14, 2006. Surely at that time, as they did with so many other suspects, would have subpoenaed his cell tower records. Why would they do it in every other situation like this, but not Mark’s?

It defies logic that they obtained dozens of people’s cell tower records with ease, but were unable to get Mark’s.

DNA Extracts are Garbage

A brief layman’s explanation of obtaining and testing DNA from crime scenes is that items are swabbed with a Q-tip then sent to the lab for screening. If a screener determines there is enough DNA material on the Q-tip then the next step is to extract the DNA. What that means is the DNA is chemically lifted, from the swab and then analyzed. There are more steps after the extraction but no need to go into those here. What’s important are the extractions.

Last week a State witness a DNA forensics expert from the City of Phoenix crime lab testified that DNA extracts are garbage when a juror asked if she needed to do a retest, which is better, the raw untouched sample or DNA that’s already been chemically extracted. Well the raw DNA, of course, was the expert’s response. In fact, if there is more raw DNA available, the extracts are tossed in the garbage. The garbage! Not even preserved for future testing. Because, she testified, you can sometimes get different results.

And that is exactly what the State has given Mark and his defense team – garbage DNA. Every single shred of raw, untouched DNA evidence has been consumed by State DNA analyst, Lorraine Heath. Even when Heath had her results, she went back and consumed DNA swabs. In some instances as the trial neared, even years later DNA was consumed by the State - even though Heath already had results.

Chromosomal Laboratories, who will be testifying at the trial, has only garbage from the State to review. Only extracts. They cannot do their own independent testing from raw samples. The State and Heath made sure of that.

DNA experts question Heath’s work ethic and roll their eyes at statements she had made on the stand. Maybe that’s why Chromosomal Labs reached out to me and offered to work on Mark’s behalf for FREE! They smell the rat.

Channel 15 Story and Wendy's Role as a Witness

I understand tonight Channel 15 did a brief story on my blog and that I wasn’t attending the trial because I am a witness. I am a mitigation witness. That means, should Mark be found guilty of any of the crimes, I will be used as a defense witness at the sentencing phase. That’s it. Even though I would be a witness after the verdict, I am still prohibited by law from attending the trial. It is not my decision not to be there.

I’m not a witness for the State in any regard whatsoever and want to be sure that’s understood. Thanks.

The Regime and the Little Guy with White Hair

The climate and culture of law enforcement officials at the time of Mark’s arrest was that of blatant corruption. A handful of men and women who defied and broke the law regularly with complete disregard for the general public. They were so arrogant and immune to their own misdeeds they conducted themselves unlawfully in broad daylight for all to see without a care in the world. So full of themselves and self assured after having lived this way for years, they felt safe and cocooned in their own corrupt world.

I’m speaking specifically about the Phoenix regime at the time of Mark’s; not the entire Phoenix Police Department, but a handful of corrupt cops and leaders: Chief of Police, Jack Harris; County Attorney, Andrew Thomas; and the little guy with white hair Baseline task team case manager, detective Alejandro Femenia, among a few others.

Chief of Police, Jack Harris is so blatantly corrupt he knowingly provided false kidnapping statistics in order to secure millions of dollars in federal grants. Once it was discovered and made public Harris was immediately demoted from his double dipping job and then forced to resign. (When Harris retired from the Phoenix Police Department in 2007, he was rehired as Public Safety Manager, collecting a state pension on top of a city salary of nearly $200,000 a year.)

In July 2010 mine and Mark’s house was burglarized while I was out for about an hour. Four members of Phoenix police department reached out to inform certain people that the burglary was ordered by Harris, desperate for information in the case against Mark. Anything containing data was stolen – computers and a cell phone. Oh, yeah, and a small container of homemade beaded jewelry. Gold jewelry, a video camera, DVD player among other things, were untouched.

County Attorney Andrew Thomas is now in the throes of being disbarred, charged with abuse of power and corruption. Judge Charles E. Jones writes that Thomas’ ethics violations “are far-reaching and numerous. Evidence thus far adduced portrays a reckless, four-year campaign of corruption and power abuse by respondent as a public official. . .”

In 2008 five members of the Phoenix Police Department and the Phoenix Law Enforcement Association went onsite to Andrew Thomas’ office and hand delivered the extensive nearly 200-page investigative report of Baseline suspect, Terry Wayne Smith. Desperate to have Smith investigated, as previous attempts to get Alex Femenia, Mike Mieshlish, Mike Polombo and other task team officials to investigate Smith had only resulted in them covering up this report as it was exonerating evidence to Mark. Not surprising that Andrew Thomas did the same, and withheld this evidence from Mark’s attorneys. I, along with Mark’s attorneys, learned of the cover up of Smith only covertly be people who knew this information was deliberately being withheld.

Detective Alejandro Femenia, acknowledged by a witness as "the little guy with white hair", retired from PPD in 2008, then began his new job working full time on Mark’s case (two years after Mark’s arrest!) for none other than his good buddy, Andrew Thomas. Corrupt birds of a feather flock together and this bird not only wasted tax payer’s money working on a case full time that had already gone to trial, but was paid a full salary on top of his PPD retirement. Femenia’s retirement/going away party is fondly remembered by his PPD colleagues as the night of “taking out the trash.”

Trial Update 9.9.11

The trial update is there really is no update. Court was held Wed and 1/2 day Thursday. Victims and witnesses who can’t ID their attacker. A slew of State DNA analyst who had excluded Mark’s DNA.

Yoshi double homicide, the previous week, was done in two days. Two days! Things move quickly when there isn't a single piece of evidence.

It's as if the State thinks the absence of evidence, is evidence. We’re still wondering how this has come this far.

Bald Face Lying Prosecutors Susanne Cohen and Patricia Stevens (Gumby and Pokey)

Seriously, it’s no wonder witnesses lie on the stand. Fortunately, those that do lie have all been impeached, always reminded and shown their original, contradicting statements documented in the police reports. But with such unethical prosecutors like Gumby and Pokey, the lying is encouraged, regardless of the known impeachment outcome, and sometimes victims and witnesses are even paid to lie. Just ask Lorena and Alejandra Lara, the two assault victims from the 2007 trial, who received $1,100 a month for an ENTIRE YEAR. A lot of money for a couple of women here illegally, working fast food.

Here’s the latest lies, err, updates from the trial. Gumby (Cohen) makes the bold statement to the judge that Mark knew the two women who were murdered in a lunch truck. She even marched one of Mark’s former managers up to the stand, Dave Diaz, who offered absolutely no connection between Mark and the two women or their lunch truck. Here’s what was brought out during his testimony:

Mark worked a good 40 miles away from the lower Buckeye homicide, near Lake Pleasant in the far away northwest part of the Valley.
Mark never purchased food from any lunch truck since he always brought his lunch and drinks from home. (I can confirm packing Mark’s lunch up for him on many occasions.)
Mark never has spoken or ever seen these women, ever.
Had Dave Diaz EVER said Mark knew these women it would have been done at an interview with both prosecutors and Mark’s attorneys present. I can tell you for fact, that interview never happened. This is just another instance of Gumby’s absurd lying.
And here’s a side note, the indictment to get Mark charged stated that a red truck was parked by the lunch wagon the day of the crime. Never mind the small detail that Mark didn’t even own the truck at the time of this crime.

Monday, 8/29, begins with opening arguments on the murder of prostitute, Nicole Gibbons, whose body was found near 24th Street and Oak. Gumby has already started with her grandiose spin of fictional tales stating to the judge that Gibbon’s “co-worker” another prostitute, said the last time she saw Gibbons she was getting into a red truck.

I just read her “co-worker’s” interview with the police and she says the last time she saw Gibbons, Gibbons was walking down Oak to 32nd Street. No mention whatsoever of getting into a red truck.
The “co-worker” also stated they serviced Hispanic men only, not Blacks.
The “co-worker” does describe one incident where they were picked up by two Hispanic men in a beige van who held a gun on them.
And that Gibbons told her, right before her death, she was beat up by two Hispanic men who drove a truck.
And again, no interview was ever conducted with this “co-worker.”
She never said Gibbons was picked up by someone in a red truck.
Mark my words, this "co-worker" won't be taking the stand.
Again, the indictment, of which Mark was charged, gives the impression Gibbons was beat up by two Black men. False information.

Witness Pete Ochoa Gets Caught Lying On Stand

I do not know or understand why people like Pete Ochoa willfully boldface lie on the stand under oath. Pete took the stand this week as a witness in the Tina Washington homicide. He testified that he recognized Mark as the person standing over Tina’s body. That he could tell by Mark’s eyes and the bone structure in his forehead that it was the same man.

Now here’s what Pete really told police. From the police report, and I quote : “Because the suspect had the hood placed over his head, Mr. Ochoa did not see the suspect’s face, so he did not know what race the suspect was.”

And by a second detective who also interviewed Pete, again from the police report “The hood to the sweatshirt was over the suspect’s head, so Ochoa never saw the suspect’s face.”

What???? Under cross examination and confronted with his own words from the police report, Ochoa admitted on the stand that he did not get a look at the suspect. Pete had told two different detectives he could not see the suspect’s face.

In the police report Ochoa had also described the suspect as 5’7’ 140 lbs. Mark is nowhere near that height or weight.

What is this phenomenon that makes less than ordinary folks lie on the stand? Why do they think they’re going to outwit an experienced trial attorney? Was he raised by bad people? Innately a liar? Just born that way? Whatever his motive to lie, Pete is an idiot and hopefully he learned a very public lesson.

DNA Hocus Pocus - Lorraine Heath

Lorraine Heath, crooked DPS DNA analyst who claims her results often were that Mark could not be excluded (never a match) and who said the chances of the DNA in the Lara case (2007 trial) being anyone else’s other than Mark’s was like 340 trillion, or some ridiculous number. Based on her work and nothing else, Mark was arrested. According to idiot detective Mike Polombo, she informed police the DNA was “an absolute match to Mark.”

The likelihood ratio calculations in Mark’s case are based on two DNA databases, the Y (paternal) and STR (more discriminating individual DNA). At the trial last week Heath was forced to admit that the Y DNA database now includes two other Y male profiles IDENTICAL TO MARK’S. These are UNRELATED males, not from the Goudeau paternal line. One is African American, the other Caucasian.

And there are less than 600 profiles in the Y database -and this database will continue to grow! How many more unrelated males will end up in this database whose profiles match Mark’s. How many unrated male matches are there in this Valley? State? Country? . . who will never end up in the database?

The likelihood ratio calculations are nothing but junk science; hocus pocus crap to confuse the general public who have no idea of all the variables and believe DNA is the magic bullet in identifying suspects.

There are also several (most) DNA results of which Mark is EXCLUDED. But we’ll learn more about that later in trial when she returns.

All and Every Men’s Shoes

Sergeant Mike Polombo took the stand a couple of weeks ago since he was in charge of the searches of our home. I can’t be there and report things first hand, but I am told by others who are there that Polombo was nervous and rambling. He tried to distance himself from the event and facts and even said he was only in the living room, when in fact he had overall responsibility for the search of our home and was likely in every room as he delegated and oversaw assignments.

You may recall that on the FOURTH search of our small home is when they “found” a victim’s ring, completely void of any DNA, in one of Mark’s shoes. On the SECOND search (or FIRST with a warrant) Polombo’s warrant directives were to seize ALL AND EVERY MEN’S SHOES. Oops. Looks like he missed the one men’s shoe out in the open with a baggie of jewelry in it.

People Who Lie on the Stand

If you’ve not heard this already, not a single victim has picked Mark out of a photo lineup. Not one person. Most pick out someone else, or say they didn’t get a good look, or simply can no longer remember the face of the suspect.

However, there are some who think it is ok to take an oath not to lie, and then lie on the stand. One guy who was working at a Little Caesar’s during a robbery said he could recognize the robber, although he never told police that. He tried to size up Mark sitting there in court. He said the robber was 6’3” and 250 lbs. Mark is not nearly that tall and about 50 lbs lighter. This guy, who never gave a suspect description to the reporting officer, was impeached on the stand by Mark’s attorney, Randall Craig. It’s just amazing that some schmuck who makes a living working at Little Caesars thinks he’s going to outwit an experienced trial attorney.

Even the jurors asked if these people know that their original statements to police are being used at the trial.

An Open Letter to DPS DNA Analyst, Lorraine Heath

There’s a new sheriff in town and it’s not Judge Klein. This is a whole new round with a respected judge that will not be led by the nose by the prosecutors. Judge Granville is by the book and has little patience for prosecutor Ms. Cohen and her antics.

As for your 2007 DNA testimony, there are many more people who now have their eyes and ears to this case. In fact, Chromosomal Labs observed your testimony in the 2007 trial and, as a result, approached Mark’s defense team to provide their lab and services for FREE. Yes, for FREE.

You might ask, what compelled Chromosomal to do this with such an enormous, high profile case? You see, ordinary citizens do not understand the complex nature of the DNA and they accepted your testimony as the gold standard, only because they didn’t understand. But those in the DNA industry roll their eyes at you and your questionable practices. They do not hold you in high regard. In fact, quite the contrary. And there are some in the DNA industry who will not stand by while you railroad an innocent man simply for monetary gain and status.

Maybe it was your limited DNA experience that made you cocky. Your newness. Or maybe it was just for pure gain, but whatever your motives, there are qualified scientists and experts who know how far out of line you are.

This is a different courtroom, with different attorneys and experts, and the game has changed.

Alejandra and Lorena Lara Do It Again
It was bad enough when Lorena Lara, at a hearing in 2007, picked out “the third guy” at the table as her attacker and that “third guy” being one of Mark’s attorney, Cary Lackey. But now at the current trial both Lorena and Alejandra Lara pick out the guy in the “green jacket.” Mark was wearing a tan suit. I guess prosecutor Suzanne Cohen is color blind since she coached these two on the wrong color.

Dic Mike and Heather Polombo
The last place dics dorks Mike and Heather Polombo wanted to be was on the stand. They reluctantly answered questions under cross examination about the 2nd search (1st search with a warrant) and the warrant directive to seize all and every men’s shoes. Both Polombo’s had integral parts of this search.

The reason this is important is that two searches and one month later is when they supposedly “found” a victim’s ring in one of Mark’s shoes, out in the open on a small 2 level shoe against a wall. If Polombos where to seize all and every shoe, how would they have missed it? Because it wasn’t there. The ring wasn’t there until Alex Femenia and Mike Mieshlish put it there on the last and 4th search.

Iselda Hernandez is Not Honest on the Stand
Iselda, a victim from the Ponchos robbery, on the stand, under oath, changes her original statement to the police about not being able to ID the suspect from the robbery. The following is from the police report dated 9/6/06.

ON 9-6-06 AT 2335 HOURS, DETECTIVE ROE AND I ASKED ISELDA IF SHE COULD IDENTIFY THE SUSPECT IN THIS CASE. ISELDA SAID SHE COULD NOT COMPLETELY IDENTIFY HIM BECAUSE SHE HAS NOT SEEN HIM FOR SOME TIME.

Iselda did point to Mark’s picture in a photo lineup after saying most of the others in the lineup were too old (Mark was 42 so how old were the other guys in the photos?) But she said she was not positive and that she really couldn’t remember.

Yet she testified at the trial a couple of weeks ago that she positively ID’d Mark as the suspect. When she’s questioned under cross, Iselda finally confesses she can’t remember. Funny how people’s memories lapse once they’re reminded what they told police originally.

From the police report:
I ASKED ISELDA WHAT MAKES NUMBER FOUR STAND OUT TO HER. SHE SAID THE MUSTACHE AND THE LITTLE GOATEE. . . . . ISELDA SAID SHE WAS NOT SURE IT WAS THE SUSPECT OR NOT. . . . ISELDA COULD NOT PROVIDE ANY FURTHER INFORMATION. THE INTERVIEW ENDED AT 233 9 HOURS.

Not a single victim has identified Mark as their attacker. Victim’s descriptions are typically of a much smaller (5’5”-5’8”; 140-180 lbs) younger, man (17-30). Mark is 6 ft and well over 200 lbs and is in his forties.

Ofc Rusty Stuart's Letter on Evidence Hidden in Baseline Investigation

Officer Rusty Stuart, now under protection of an attorney because of retaliation from PPD, has new Terry Wayne Smith evidence and composes a letter to interim County Attorney, Richard Romley. Rusty goes into detail on how he is told to go away when he brings forward evidence that exonerates Mark and then finally told to put the nearly 200 page report into a format making it virtually irretrievable. Demoted Dic Schoville Takes the Stand 6/29

In an effort to minimize Sue Schoville’s immense screw up in her part of the Baseline investigation, she misstates on the stand that it was her decision to go from detective back to patrol. The truth is Schoville was probably demoted as a result of her unbalanced zeal in investigating and then indicting James Mullins, a Kentucky inmate who falsely confessed to the George Thompason murder after seeing it on a day time TV show. Based on nothing more than his false confession and with interview statements that didn’t add up, Schoville had Mullins indicted and transported to Phoenix, where he sat in jail for nearly a year until someone finally rained Schoville in.

Her ineptness is described by Mullins himself in Phoenix New Times article I Dunnit. "She was very eager," the inmate recalls. "It was like holding a carrot in front of a mule and leading it around. If she would have just looked into what I was saying . . . the shit I was putting out was obviously bullshit."

The article doesn’t discuss Schoville’s demotion, but really Sue, what detective decides to return to patrol? Who voluntarily takes a 50% salary cut? Are you sure this wasn’t a demotion as a result of your egregious work in the Baseline investigation?

Schoville weeped on the stand as she admitted to jurors of her screw ups in the Baseline investigation.
This sloppiness and over eagerness held tight throughout the entire Baseline investigation, even permeating the Phoenix Police Dept, winding up with a rush to charge Mark after bad information from DNA analyst, Lorraine Heath, and absolutely NOTHING that pointed to him as a suspect. Thus leaving detectives Alex Femenia and Mike Mieshlish with having to do damage control a month after Mark’s arrest with no evidence - enter the so-called DNA evidence and a ring after multiple searches of our small home - a ring out in the open, void of any DNA - neither the victim’s nor Mark’s, missed by seasoned detectives time and time again.

Schoville’s screw up with the Baseline investigation was just the beginning of many.

Terry Wayne Smith Cover Up

For those of you who don’t know about the cover up of Baseline Killer suspect, Terry Wayne Smith, here’s the Reader’s Digest version to get you up to speed.

Prior to Mark’s arrest September 6, 2006, Phoenix police officer Rusty Stuart was nearing the completion of a long, intensive investigation of Terry Wayne Smith. Based on TWS’s sociopathic behavior, connection to every single Baseline crime scene, bloody clothing, TWS family members calling TWS the Baseline Killer, and other factors, Rusty is convinced TWS has something to do with the crimes. He compiles his investigation and produces the entire report (nearly 200 pages) to the lead dics on the Baseline task force, Alex Femenia. Rusty makes several attempts to get Femenia to further investigage TWS but is dismissed. At one request, Femenia become very confrontational. Rusty is appalled at lead dic Alex Femenia’s “dereliction of duty.”

In 2008, Rusty, with four other PPD cops and Phoenix Law Enforcement Association members then take the report to the County Attorney’s office and present it to Andrew Thomas’s right hand man, Keith Manning. Manning and Thomas continue to hide the evidence and it is never produced to Mark’s defense team.

Until that is underground forces surface the report. When Randy Craig, one of Mark’s attorney’s, starts shaking trees and making calls to find this report, Susanne Cohen, County prosecutor, coughs it up. Yes, the prosecutors knew of this report since 2006. The grand jury which indicted Mark never heard of Terry Wayne Smith. Susanne Cohen and Bill Clayton allowed Mark to go to trial while they hid this evidence.

Suzanne Cohen would like everyone to believe she was quoting the Bible in the June 6 opening argument. But Cohen doesn’t have a biblical bone in her body – she lies, hides evidence, pays and coaches witnesses to bend testimony, and has no problem furthering her career off the backs of innocent people.

Her quote “He’s a ravenous wolf and you’ll know him by his deeds” is taken completely out of context. Not to mention not even quoted accurately. The actual scripture is Matt. 7:15 where Jesus warns of false teachers OR Genesis 47.1-28 where Jacob describes his son, Benjamin.

Cohen deliberately misrepresents the scriptures in her design to confuse and deceive. She will poison anything that is good, including the Bible. Yesterday lead prosecutor, Suzanne Cohen, even lies in her opening argument in a court of law. In an effort to downplay the number of searches of our small (1,100 sf) home, Cohen lied saying the home had only been searched twice. WHAT?? Mark’s attorney, Randy Craig, corrected that in his opening argument letting all know it was FOUR searches before the so-called WalMart ring was found. Four times! The first search was done while Mark was home. (Cohen would like everyone to believe that Mark was smart enough to get rid of a gun – since there wasn’t one found in our home – but dumb enough to leave an engraved ring in an open area for anyone to see. ) There were four searches, not two.

Lying is ugly. Just look at it.

The Baseline composite most of us are familiar with was the one on the billboards across Phoenix in 2006 and months after Mark's arrest. What most people don’t know is there was another well hidden composite that was used during the 2007 trial. Here they are side-by-side, remarkably different.

The day has come and tomorrow is opening arguments. We are both nervous about trial and going in front of a jury of Mark’s “peers”, yet happy to finally have the opportunity to have the truth come out in a court of law.

Some of the recent developments include:

**Phoenix Police Fallen Regime --The very regime that the Baseline taskforce operated under is falling apart. County Attorney Andrew Thomas has been investigated (not on this case) and will no doubt lose his license to practice law due to corruption and abuse of power. (Thomas withheld the Terry Wayne Smith 160+ page report from Mark’s defense team.) Also double dipping Police Chief Jack “I Am Not Stepping Down” Harris has resigned after a fraud investigation by the Office of Inspector General. I am told Harris was the ringleader of the burglary of our home last summer in a desperate attempt to find any information that would help their case against Mark. Explains why two computers and a cell phone were taken, nothing else. Only items with “data.”

**Detective Dave Barnes, who was one of the detectives on the Baseline Investigation, will be a witness for us, not the State. As a result, not only has Barnes has been harassed by Phoenix police brass and placed on administrative leave, he also finds himself charged in other matters - all a direct result of this case. Judge Granville asked the prosecutors to give Barnes immunity at the trial, but before he could even finish his question, prosecutor Susanne Cohen’s response was “No!” (Dave Barnes has information on the Terry Wayne Smith cover up, the disappearance of Mark’s cell tower location records, and searches of our home.)

**Not only did Phoenix Police, County Attorney Andrew Thomas, prosecutors, William Clayton, Suzanne Cohen and Patty Stevens, knowingly withhold the 160+ page report on Baseline suspect Terry Wayne Smith, they had the nerve to file a motion to try to prevent that evidence from being used at trial. Prosecutors lost that motion and not only will Rusty Stuart take the stand, the officer who wrote the report and took it numerous times to the Baseline task team, only to be told to go away, but Terry Wayne Smith will be on the stand as well.

**During jury selection any jurors who understood anything about DNA were removed by prosecutors. Speaks volumes that they wouldn’t want anyone to see what crap their so-called DNA evidence is.

These are only some of the things that have taken place. We hope to shed light on it all at trial.

Prosecutors Lose, May 31

At a May 31 hearing, the State argued that they should be allowed to say in opening argument that the crimes stopped after Mark’s arrested. Seriously? As if PPD would attribute any crimes to the Baseline crimes after Mark’s arrest. Judge Granville agreed and said their motion was “a bridge too far.” Prosecutors will not be allowed to say that in opening argument, nor during trial.

Note: Let’s not forget one month after Mark’s arrest, Terry Wayne Smith was arrested for beating up an elderly man at a bus stop, and has been incarcerated ever since.

Jury selection wrapped up last week and Mark’s attorneys did manage to get two people of color. Not exactly a jury of Mark’s peers, but Mark’s attorneys do feel that this group consists of some intelligent people, unlike the jurors in the 2007 trial. Mark’s then attorney, Corwin Townsend, used an old defense attorneys’ strategy of choosing less than intelligent people thinking confusion leads to acquittal. We all saw how that trial turned out. Better to have smart people who understand the evidence, or lack of, for what it is.

Last week during the jury selection process it was discovered during questioning that one gentleman proved to be well versed in DNA. Needless to say he was quickly striked by the prosecutor Susan Cohen and Patty Stevens. Speaks volumes as the State’s case hinges pretty much entirely on so-called DNA evidence, yet they don’t want any jurors who really understands DNA. They couldn’t get rid of that guy fast enough.

Letter from Ofc Rusty Stuart where he writes of his repeated efforts to have Terry Wayne Smith investigated further by the Baseline task force - Alex Femenia, Mike Polombo, Mike Mieslish. Ofc Stuart also took his nearly 200-page TWS report to the county attorney's office, where it was also swept under the rug. Let's not forget Andrew Thomas is in the process of being disbarred due to abuse of power and corruption while holding that office. TARGETED - Mark Called Baseline Killer Before Any Investigation Whatsoever!

July 14, 2006, unemployed, mentally unstable, methamphetamine addict, Darlene Candice Fernandez, calls the Baseline task team reporting that she felt Mark was the Baseline Killer. When Darlene didn’t get a call back right away that same day, she escalates the situation and calls the Department of Corrections to try to get them to do something. DOC springs into Keystone Cop action and Todd Gerrish calls the Baseline task team suggesting that Mark resembled the composite and that they had been contacted by Darlene. Todd also misinforms the task team saying that Mark was a level two sex offender. Good job, duh, Todd. Utterly untrue.

Notonly did Darlene lie to police after she was beat up by her boyfriend, telling them Mark was her attacker, she also told police that Mark had raped her. Forensics didn’t support Darlene’s claim of a rape and without physical evidence of a rape, Mark was not charged with rape, never served time for rape, and was not placed on parole as a sexual predator.

The night Darlene was beat up by her boyfriend she was blood tests showed she was high on cocaine so she claimed Mark forced her to snort cocaine. How do you force someone to snort cocaine? Darlene has been arrested twice since that night. One of the arrests was a result of her buying meth from undercover cops in a west side bar parking lot - Wonder who forced her to do that. . . . . On another matter when Darlene was being subdued and escorted out of a bar by police due to the owner complaining about her obnoxious insane behavior, she yells on her way out that the owner is a child molester. Seems anyone who crosses this drug addled women is going to be accused of a sexual crime. Darlene lied about the rape, she lied about her drug use, and she lied about who beat her up.

Back to July 14, 2006, Phoenix police reports state that armed with nothing more than an accusation from mentally unstable, meth addled Darlene Fernandez and Todd “duh” Gerrish’s blatantly wrong information (would have taken 5 minutes to research to get the facts!) members of the task team contacted Mark’s parole office that very day asking to violate Mark’s parole and arrest him, calling him “the Baseline Killer.” With no evidence! No evidence! Not a single thing other than a call to the tip line. NOTHING! The tip line received 100s and 100s if not 1000s of tips on other people, of which many, many weren’t even followed up.

Since Mark was in complete parole compliance and could not be arrested, he was then placed on surveillance for two weeks, before it was called off due to “no suspicious activity.”

The exhausted, over worked, task team lead by corrupt detective Alex Femenia (et al) jumped the gun, and rushed to charge Mark armed with tenuous DNA information only. Be mindful that Mark only matched 3 out of the 13 genetic DNA markers – not even sure how he was even been arrested on that.

Left with crappy, inconclusive so-called DNA evidence and nothing more, Alex Femenia was left to do damage control. No evidence “found” until the FOURTH search of our small home.

Alex Femenia received an award for breaking the case. Curious what he received monetarily. And now a proud double dipper of your tax dollars by retiring from PPD and then being rehired at the County Attorneys office to work on Mark’s case full time, drawing both a full pension and salary.

Media Hype vs The Facts

Trial is to begin early June. We’ll be relieved to get the true facts into open court. The media has done they’re usual job of sensationalizing and hyping, misrepresenting the facts, and portraying Mark as a monster. For those of you who unfortunately rely on local media to educate yourselves here are some facts you’ll never read there:

By far, the majority of the suspect descriptions by victims is a smallish man, 25 -35 years old. Mark is a large man who wears XXL, big and barrel chested. He was 43 when he was arrested in 2006. He’s too old, he’s too big, but he is just Black enough.

Mark is excluded from every single crime scene latent print.

Not only is the DNA NEVER a match to Mark’s DNA, in some of the cases it is environmentally impossible for there to be any useable DNA evidence. The State will not be allowed to use the term “match” in court when referring to the DNA.

Many, many, many pieces of DNA evidence EXCLUDES Mark. Not inconclusive findings – he is excluded completely!

Not a single witness has ID’d Mark. There is this one women who has been coached by the prosecutors all these years later. Judge Granville in open court advised Mark’s attorneys to simply impeach her. BTW – Prosecutor Susanne Cohen called defense attorney, Randy Craig, and told him they have reconsidered their strategy since the woman, in Cohen’s words, is mentally challenged.

The Baseline task team – Alex Femenia, Mike Misliesh, Mike Polombo, Heather Polombo; prosecutors Suzanne Cohen, William Clayton, Patty Stevens; County Attorney’s office Andrew Thomas, Keith Manning, and others concealed a nearly 200 page police report on Terry Wayne Smith since 2006. They didn’t wan to give Mark an alibi and withheld this report when he went to trial in 2007. Mark’s defense team was made aware of the report only after I was approached by a contact close to Phoenix Police Department in 2009.

Mark called a Nigger by members of the task team. I’m told specifically by Alex Femanie. Read the Phoenix Law Enforcement Association’s memo here. It also includes an officer's remark that it would be “no surprise if evidence had been planted.”

One thing that Mark and I learned at the Lara trial in 2007 is that you cannot count on the truth being told. Information is repressed, watered down, prosecutors lie, coach and pay witnesses, hide exculpatory evidence, and so on. Nor can you trust the local media to get the facts straight since the local media is nothing more than a mouth piece for police and prosecutors.

One local journalist, Shanna Hogan, does get it based on her extensive research and interviews with offices of Phoenix PD. She’s written two articles so far with actual facts in regard to the issues with the entire Baseline investigation, including the so-called DNA evidence. Shanna is an acclaimed journalist and recent winner of the Journalist of the Year award by the Arizona Press Club specifically for her investigative work and articles on the Baseline investigation. A very prestigious award.

Audio Line Up

It’s true the audio lineup tapes are being admitted as evidence and we can hardly believe it. Three years after her attack, PPD compiles 6 audio tapes; one with Mark’s voice, the other 5 of police officers. Each is just a short snippet looping over and over. Mark’s audio piece is immensely different in that his echo’s substantially and the audio quality of the cops is far superior and clean. Mark’s audio portion is described as sounding like he’s in a “cave.” This is an old police trick to ensure a suspect is picked out by creating a difference between him and the others it’s compared to.

Thursday’s (2/17/11) Arizona Repugnant’s Michael Kiefer says that Mark’s voice was picked out by a victim (let’s not forget 3 years later!) because of his “distinctive, twangy voice.” What can I say but that Michael Kiefer is a complete moron who has NEVER heard Mark speak. If he had, he would know that Mark’s voice is not twangy, not even in the remotest possibility. Interesting that Michael doesn’t write that the even the victim doubted she picked the right one.

Terry Wayne Smith Cover Up and Feb 2-3 Hearing

After an hour or so of observation at the two-day Feb 2, 3 hearing, Michael Kiefer wrote a police-sided article, typical of the Arizona Republic and local media. He eagerly quoted lead PPD dic Alex Femenia who said Wayne Smith couldn’t even plan his own lunch much less a crime. He seemed to miss the full day of testimony of Office Rusty Stuart who said Femenia’s conduct at hiding the Smith evidence was derelict in his basic duties as a PPD detective and, in fact, a “felon.”
Well, the judge’s decision is in and it is to allow the Smith evidence into the trial, that the evidence is relevant, therefore admissible.

Not only that, Judge Granville goes on to state that the only “real issue in the trial is identity.” “Despite its projected length and the number of the disparate crimes and crime scenes, the only issue in this trial will be identity. That said, no one crime scene had a complete combination of eyewitness, biological, and ballistic evidence. The witness accounts were not identical. The descriptions of the male suspect varied. The biological evidence was scant.”

What?? Where is the “mountain of evidence” PPD spokesperson Andy Hill reported there is. (Andy Hill is a small guy so I suspect everything is a mountain to him.) Even Judge Granville refers to the biological evidence as “scant.”

County deputy attorneys Susan Cohen, William Clayton, and now Patty Stevens; PPD dics Alex Femenia, Mike Polombo, Mike Meishlish, Lt. Pina, et all CONCEALED the Terry Wayne Smith, nearly 200-page report, for years. Even allowing Mark to go to trial in 2007 while they withheld evidence of this other very viable suspect.

Officer Stuart made FOUR attempts to get Alex Feminia, the Baseline case agent, to take the report and follow up on his investigations. He was met with racial slurs in reference to Mark and ordered to put the report in a format making it virtually un-retrievable.

Stuart made a final attempt to have the report followed up on and he when four other members of PPD and Phoenix Law Enforcement Association took the report to Andrew Thomas’s right hand man Keith Manning, who then also concealed it. (Small wonder Thomas’s recent investigated into unrelated corruption charges resulted in a recommendation that he lose his license to practice law.)

Only after covert sources approached me and Mark’s attorneys did we learn of this report. And when Mark’s attorneys started shaking trees to get to the bottom of it, Susan Cohen requests an emergency hearing producing the Smith binder, first saying “we just got it” and then says “it’s not exculpatory.” So which is it Cohen? Did you just get it or did you not turn it over because you deemed it not exculpatory. More double speak from this prosecutor desperate to hide the fact she unlawfully withheld exculpatory evidence.

Terry Wayne Smith Cover Up

For those of you who don’t know about the cover up of Baseline Killer suspect, Terry Wayne Smith, here’s the Reader’s Digest version to get you up to speed.

Prior to Mark’s arrest September 6, 2006, Phoenix police officer Rusty Stuart was nearing the completion of a long, intensive investigation of Terry Wayne Smith. Based on TWS’s sociopathic behavior, his connection to every single Baseline crime scene, blood on his clothing, TWS family members calling TWS the Baseline Killer, and other factors, Rusty is convinced TWS has something to do with the crimes. He compiles his investigation and produces the entire report to the lead dics on the Baseline task force. Rusty first takes his report to the Carmen Miranda crime scene and he is dismissed. He makes several attempts after that to get it to the lead task force dics and continues to be dismissed. Rusty is appalled at lead dic Alex Femenia’s “dereliction of duty.” Rusty, with four other PPD cops and Phoenix Law Enforcement Association members then take the report to the Maricopa County Attorney’s office and present it to Andrew Thomas’s right hand man, Keith Manning. Manning and Thomas continue to hide the evidence and it is never produced to Mark’s defense team.

Until that is, underground forces surface the report first to me and then Mark’s attorneys. When Randy Craig, one of Mark’s attorney’s, starts shaking trees and making calls to find the entire 180 page report, prosecutor Susanne Cohen coughs it up. Yes, the prosecutors knew of this report since 2006, yet they too kept it under wraps. The grand jury which indicted Mark never heard of Terry Wayne Smith. Prosecutors Cohen and Bill Clayton allowed Mark to go to trial while they hid this evidence.

Well now the cat is out of the bag and only because of good cop, Rusty Stuart, and other individuals the TWS report is now in the hands of the defense team. Had covert sources not brought this information forward, prosecutor Cohen, lead dics Alex Femenia, Mike Mieslish, Mike Polombo, Andrew Thomas, and mayor Phil Gordon would still have had it under the rug. The TWS report was hidden for years.

When Rusty Stuart took the TWS information to Alex Femenia, Alex responded “Why would you want to give this NIGGER an alibi?” Rusty is also concerned, and rightly so, about evidence being planted. Although the prosecutors', lead dics and County Attorney Andrew Thomas conduct is shocking, they continue to try to hide evidence. Now the prosecutors, Susanne Cohen and Patty Stevens, are trying to prevent the cover up of Terry Wayne Smith from being used at trial. Tobe argued in front of Judge Granville Jan 19, 2011. Let’s hope justice prevails and this corrupt and dishonest behavior and hiding of evidence is stopped. I dare to even imagine what other exonerating evidence the State is hiding.

Goudeau Home Burglarized

It's been a while since I've blogged with any updates and I am way over due.

First, July 2010, mine and Mark's home was burglarized while I was away for a little over an hour. I arrived home, unlocked the front door and immediately noticed my computer was gone and a side door was open a few inches. It reminded me of the numerous previous searches by PPD. (Little did I know about this one.) Horrified, I had no other choice other than to contact PPD to secure the premises. One cops arrived we surveyed and I then realized they had taken two computers and an old cell phone that was laying out. No VCRs, TV, digital camera, an external drive for backing up date, jewelry or anything else was taken. Only items with data and information.

Later that afternoon while my family was helping me change the locks I received a call from a friend who has strong contacts within PPD. He called to see what was going on as he had received four phone calls from four current members of PPD who told him PPD had burglarized my home. They couldn't justify a search warrant so they handled it another way, I guess. Anyway, my friend was told that PPD is desperate for information, therefore, computers and cell phones were taken, nothing else.

The burglary of our home by PPD came on the heels of the State filing motions to consume more items for DNA. FOUR YEARS after Mark's arrest and they still feel the need to consume for DNA. I like to refer to it as destroying the evidence and covering their tracks. The consumption of yet more DNA items and the burglary of our home only speaks to PPDs corruption and complete reckless actions to secure a conviction. I don't mean to disparage all of PPD, surely there are good cops there who just want the world to be a better place. However, I am speaking about a handful of cops and detectives who's butts are on the line for rushing to charge a man who has absolutely nothing to do with the Baseline crimes. Now they are left to build a case and produce evidence. I would think this normally done before a person is arrested. Duh.

The backslapping and "atta boys" are over and now the likes of Alex Femenia, Polombo, and others are scrambling to save their careers and who knows what else these thugs are capable of doing. I keep my doors locked, have installed a security system, and the neighbors are on alert.

DNA's Dirty Little Secrets - 2010 Article

Most of the BK cases don’t have DNA evidence, the only thing supposedly linking Mark to some of the crimes. (Most of the crimes can’t be linked to anyone.) What DNA is available is in miniscule amounts, degraded, and mixtures, which complicates things (enormously) in interpreting results.

I came across this article - DNA’s Dirty Little Secret -and a lot of it could have been written for Mark. Notice this quote from world renowned Dan Krane, "If you show ten colleagues a mixture, you will probably end up with ten different answers." Dan Krane, a molecular biologist at Wright State University and a leading critic of the government’s stance on DNA evidence, agrees. "There is a public perception that DNA profiles are black and white," he told me. "The reality is that easily in half of all cases—namely, those where the samples are mixed or degraded—there is the potential for subjectivity." It's been a while since I've posted anything on the case, so here's the latest.

First, Alex Femenia, the lead dic on the Baseline task force, retired from PPD, but currently employed at the County Attorneys office to work full time on the prosecution of Mark, and yes he is double dipping with a pension and salary. Femenia and prosecutors have won a motion to consume yet more DNA. Four years after Mark's arrest. FOUR YEARS. This is not only an attempt to cover their tracks by consuming (destroying) what ever physical evidence is left, but an act of desperation. Continue reading to learn more. . .

Secondly, last Tuesday, July 13, mine and Mark's house was burglarized. Both personal and work computers and a deactivated cell phone were stolen. That afternoon I was contacted by blogger Jeff. Jeff is one of the bloggers of badphoenixcops.blogspot.com, a blog where good cops can anonymously post information on bad cops and corruptions. The blog has been invaluable with posts from PPD cops about cover ups and mishandling of evidence by lead BK task team dics, Alex Femania, Mike Polombo, and Mike Meishish. PPD has even unsuccessfully tried to shut down the blog by searching Jeff's house, indicting and charging him. (All charges have been dismissed by a judge.)

Back to the burglary. That afternoon after our house was burglarized, Jeff received at least four phone calls from current PPD officers who told Jeff the burglary was staged and done by PPD in a desperate attempt to get "information." Hence cell phone and computers were taken. No VCRs or TVs stolen. Other things were done to make it appear as a burglary i.e. bedroom drawers were each opened a couple of inches with clothing tugged on, if you will. The clothing and items in the drawers were not disturbed at all. Also two bowls of crappy beaded jewelry were taken, along with two pieces of jewelry that were heirlooms from my grandmother.

One of the offices that called Jeff that afternoon said that it was with 100% certainty that the burglary was done by PPD in a desperate attempt to find anything that would help them, that they're very concerned of a mistrial.

Here's why: The three primary corrupt dics on the Baseline task team - Femenia, Meishlish and Polombo are disliked by most cops at PPD. Polombo is referred to as Mr. Potato Head and his wife, Heather, as Mrs Potato Head. If you've seen Polombo you know why.

As for Mark, he is angry and concerned about my safety - god only knows what these desperate goons will do - but he is his usual strong self.

PLANTING EVIDENCE AND COVER UPS Through anonymous sources at the Phoenix Police Department Mark's defense team was notified of another viable suspect, Terry Wayne Smith, which PPD had tried to cover up by sitting on this information since 2006. They even went as far as converting it from the usual electronic format into Word. A Word document in the PPD's electronic retrieval system is virtually impossible to retrieve.

An extensive investigation was done on Smith by a gang squad officer and it was determined he is responsible for the BK crimes. Police reports show he's even admitted to some of the crimes.

So what does PPD, prosecutors, Suzanne Cohen, Patty Stevens, and William Clayton, Andrew Thomas, police chief Jack Harris, Mayer Phil Gordon, and other city officials do? They attempt to cover up the evidence! Had it not been for internal anonymous PPD sources, Mark's defense team may have never learned of this cover up. But the team did and filed a subpoena for the extensive 100+ page police investigation on Smith and unscrupulous prosecutors, Cohen and Clayton, were forced to produce the 3-ring binder in court, March 20, 2009. Only after being caught and forced! In an attempt to CHA, Cohen remarked in court "we have no position on this." In other words, now caught in the act of hiding clearly exonerating evidence for Mark, she felt that if she took NO position, that her hide might be saved from the actions of her malicious behavior. But wait! Cohen also said at the hearing that the TWS report was not exculpatory. In another desperate attempt of trying to save her skin Cohen prattles on that she just got the TWS report.

So which is it Cohen did you just get it? Do you have no position on it? Or is it not in Mark's favor so you didn't feel compelled to turn it over? And BTW it's not the prosecutor's decision whethere discovery is exclupatory or not, it's up to the judge. So ALL DISCOVERY must be turned over regardless of what the prosecutor thinks.

Now the Phoenix Law Enforcement Association (PLEA) has revealed that there are more cover ups. Again from anonymous sources within Phoenix Police, that it is highly likely evidence was planted in Mark's case. In this letter to Joe Arpio from PLEA President, Mark Spencer, there are even comments from lieutenants and sergeants in the Violent Crimes Bureau referring to Mark as a N--R!
